Debating The Motion To Suspend Gobind

The tabling of the motion to suspend Gobind Singh from Parliament for a year by Datuk Seri Nazri Aziz is intriguing.

The motion reads as follows (taken from YB Lim Kit Siang’s blog):

ATURAN URUSAN MESYUARAT DAN USUL-USUL

Menteri di Jabatan Perdana Menteri akan mencadangkan:

BAHAWA pada 12 Mac 2009, Yang Berhormat Tuan Gobind Singh Deo, Ahli Parlimen kawasan Puchong semasa perbahasan peringkat Jawatankuasa Rang Undang-undang Perbekalan Tambahan (2009) 2009 telah mengeluarkan kenyataan-kenyataan yang mendakwa YAB. Timbalan Perdana Menteri, Ahli Parlimen Kawasan Pekan terlibat dalam kes pembunuhan.

BAHAWA Yang Berhormat Ahli Parlimen Kawasan Puchong juga telah mengeluarkan kenyataan-kenyataan yang menghina Timbalan Yang di-Pertua Dewan Rakyat setelah diperintah keluar Dewan.

DAN BAHAWA kenyataan-kenyataan yang dibuat oleh Yang Berhormat Ahli Parlimen Kawasan Puchong adalah merupakan satu dakwaan yang sangat serius dan menyalahi hak dan keistimewaan sebagai Ahli Parlimen serta merupakan satu penghinaan kepada Dewan ini.

MAKA INILAH DIPERSETUJUI BAHAWA Yang Berhormat Ahli Parlimen Kawasan Puchong hendaklah digantung tugas dari jawatannya sebagai Ahli Parlimen selama dua belas (12) bulan dari tarikh keputusan usul ini diluluskan. Dalam masa penggantungan ini Yang Berhormat Ahli Parlimen Kawasan Puchong tidak akan dibayar kesemua bayaran elaun dan kemudahan sebagai seorang Ahli Parlimen.

It appears that the motion is grounded on Gobind having abused parliamentary process and privilege in accusing the Deputy Prime Minister of being involved in the murder of Altantuya Shaaribuu.

Leaving aside the questions of whether the matter ought more properly be taken up before the Committee of Privileges and whether the suspension of the Puchong MP for a day on 12th March brought the matter to a close, it is significant that a debate of the motion must necessarily involve discussion of whether Gobind Singh had conducted himself inappropriately.

This would necessarily involve a consideration of whether the making of the accusation was warranted which in turn would involve a consideration of the very matters that the Deputy Speaker had directed Gobind Singh not to speak about on the basis that the matters were “sub-judice”.

If the sub-judice ruling holds, then the motion cannot be debated.

The motion is of punitive nature, it aims at suspending Gobind Singh without allowances and privileges. The MP must therefore be given every opportunity to state his position squarely. Additionally, all other MPs must be given an opportunity to debate the motion fully in order that the issue is fully ventilated. As such, the Speaker cannot limit the scope of debate by ruling that reference to the Altantuya case and its investigation is not permitted. This would be akin to the MP being asked to step into a boxing ring with his hands tied behind him.

If the Speaker allows full ventilation of the issue, it would not only be inconsistent with the ruling of the Deputy Speaker on 12th March and other prior rulings that have impeded the raising of the Altantuya matter in Parliament, it would also permit the Altantuya matter to be raised in Parliament.

I am not certain who stands to lose more if the motion is permitted to be debated.

But these wily guys do make up rules as they go along.....

Will they achieve what they want?
Only consolation is seeing Najib to be such a lousy strategist (just look at Perak), maybe this too will fall flat on their faces.

Thank you for enlightening us! The judicial commissioner, some judges and Dewan Speaker/deputy speaker have interpreted matters according to their own partisan leanings and have left our heads spinning.. Good to read some logical and lawful interpretation of these very serious matters.

It is obvious now that every BN minister is scrambling to show their siding with the new king to be enthroned shortly.And for Nazri, this is a clumsy move, at the expense of Malaysia's parliamentary democracy.

If this is allowed to set the precedent, and given the fact that almost all opposition MPs are capable of "committing such offence", it is not impossible to see all opposition MPs getting suspended the same way. It will then surely be smooth business for BN government, and the darkest moment in our history.

Menarik perkembangan ini. Bermula dari tindakan speaker Perak menggantung enam Adun , kini BN lebih berminat untuk menggunakan taktik-taktik ini. Seperti yang saya sedia maklum sebelum ini. Malaysia sedang mengharungi Zaman kehancuran dan saya tidak nampak pun wawasan 2020 atau apa-apa Visi akan dikecapi.

Tanggapan saya mungkin bagi setengah orang agak keterlaluan, tetapi adalah lebih baik menerima kebenaran walaupun pahit.

Sekiranya tindakan menggantung Gobind berjaya. Apakah Implikasi kepada perkembangan politik masa akan datang? Pembangkang memang tidak dapat bersuara, bukan sahaja pembangkang Ahli-ahli Yang Berhormat dari pihak kerajaan juga tidak boleh bertindak bertentangan dengan pucuk kepimpinan.

Kedua, Dimana batu asas demokrasi dan kekebalan dalam Parlimen? Parlimen sepatutnya bebas daripada peraturan2 umum( Di luar Dewan) tapi Mark Koding tidak terlepas. Campuratangan mahkamah yang dikuasai oleh Kerajaan juga akan mengiakan semua tindakan speaker adalah sah. Jadi adakah wakil-wakil rakyat ini dapat menyampaikan suara rakyat?


Ketiga , kejayaan mengantung Gobind juga akan membawa satu lagi kejayaan untuk mengurangkan pembangkang atau menafikan suara rakyat dengan menggantung lebih kurang 10 Yang Berhormat sudah memadai.

Yang bagusnya dan Tahniah diucapkan kepada Spoeaker, Kes Liwat Anwar boleh diutarakan , Cuma kes Najib yang tak boleh. mmmmm


Semoga terkuburlah Demokrasi . Kemusnahan selama 22 tahun mula menampkan hasil. Kalau nak lebih rancak warisnya perlu naik.

Selepas ekonomi menjadi semakin kritikal, caruman Epf merundum pulangannya, IMF dan dan syarikat-syarikat asing pasti akan menawan ekonomi Malaysia atas nama globalisasi.

Negarawan terulung ialah negarawan yang tidak mengadaikan sebarang prinsip atau menodai sebarang sistem agar generasi akan datang juga akan turut menghormati prinsip-prinsip tersebut.
Adakah kat Malaysia manusia seperti Al-Gore yang akur ketika pilihanraya? ataupun Nixon ataupun Bill Clinton yang terpaksa mengaku perbuatanya sebab sistem yang dipertahankan. Renungkan dan nafikan.

take the case to court in Iph and ask Ridwan to be the judge. See how this UMNO judge makes the decision

y asked Gobind to go into the ring, he jumped into a ring where no one is suppose to jump into and for that he is kicked out

Surely an MP's immunity is not unlimited in the sense that they can slander anyone they like

Or is this the typical Anwar fanboys cherry picking?

If you allow them to debate the motion they will simply continue with their slander, thus making the suspension pointless

I say you should call Gobind and his father and tell them not to act like bullies in parliament, nanti orang marah, kata orang nak threaten lah, nak pukul lah,

you can accuse the Government of incompetence all you want and you can certainly accuse the mini budget of being inadequate, ill conceived or whatever else but to get personal, that is just petty

maybe somebody should make a police report and take the matter to court ( better still if the judge is Mr Ridwan) against Dato Nazri Aziz and also the Deputy speaker and maybe mr Ahmad Said of SPRM can look the matter also TOO FOR MISS USE OF POWER BY BOTH OF THEM.

Looks like the PM-in waiting has his "clonies" stand guard to defend & protect him by hook or by crook be it in Parliament, Court of Law, Laws Enforcement arms (PDRM & AG)and in the Public Front justify by his lovely spouse to declare his innocent. If he truely become the PM then the Executive will be under his whip. At the end, who stand to loose ? All the Right thinking Rakyat inside the Parliament or on the streets are as good as being C4 like Altantuya although the difference is we Rakyat, can use the ballot box as C4 to show our power but Altantuya will be a legend !
